The Court of Appeals has junked the petition of businesswoman Janet Lim Napoles to nullify and reverse the Department of Justice (DOJ) resolution which found a probable cause to charge her of illegal detention.

In a 23-page decision issued by the appellate court, it said that it found no grave abuse of power when the DOJ found probable cause and indicted Napoles of serious illegal detention.

Napoles is the alleged brains behind the multi-billion pork barrel scam. Her serious illegal detention case stemmed from a complaint filed by pork scam key whistleblower Benhur Luy.

The CA has also junked Napoles’ plea to quash the warrant arrest issued against her.

Serious illegal detention is a non-bailable offense and the businesswoman will continue to be detained in Fort Sto. Domingo in Sta. Rosa, Laguna.
